Terms of Use for AmazighShop.com

Welcome to Amazigh Shop. These Terms explain the rules for using our website and the conditions that apply when you browse, create an account, place an order, purchase physical, food, custom-made, personalized or digital products, or otherwise use our services.

Last updated: September 27, 2026 • Website: amazighshop.com • Email: [email protected]
About Amazigh Shop: Amazigh Shop operates from Poland and Morocco and works with cooperatives that produce or prepare many of the products sold through our website. Worldwide delivery is offered where the relevant product, cooperative and available carrier can serve the customer’s destination. Please review the product, shipping and return terms before ordering.

1. Introduction

These Terms of Use (“Terms”) apply to your access to and use of amazighshop.com and to purchases made through the website. “Amazigh Shop,” “we,” “our,” and “us” refer to Amazigh Shop, with business locations at Aleja Armii Krajowej, Starachowice, Poland, and Inezgane Ait Melloul, Morocco.

Amazigh Shop offers physical products, food products, digital products, and custom-made or personalized products. We also work with independent cooperatives and fulfilment partners that may produce, prepare, personalize, package or dispatch products ordered through the website.

These Terms do not remove or reduce any mandatory consumer rights that apply to you under the law of your country or region.

2. Acceptance of These Terms

By using our website, creating an account, placing an order, purchasing or accessing digital content, or otherwise using our services, you agree to these Terms together with our Privacy Policy and any product-specific conditions shown before purchase.

If you do not agree with these Terms, please do not use the website or place an order.

We may update these Terms when our services, business practices or legal obligations change. Changes apply prospectively from the date posted and do not retroactively change the terms of an already accepted order unless applicable law requires otherwise or you expressly agree to the change.

3. Eligibility

You may place an order only if you have the legal capacity to enter into the transaction under the law that applies to you. If you are under the age required to contract independently, a parent or legal guardian must be involved where required by law.

You must provide accurate, complete and current information, including your name, contact information, billing information and delivery address. We are not responsible for delays caused by inaccurate information where the delay could not reasonably have been prevented by us.

4. Customer Accounts

You may be able to create an account to manage orders and use website features. You are responsible for maintaining the confidentiality of your login credentials and for taking reasonable steps to prevent unauthorized access.

  • Provide accurate and current account information.
  • Do not share your password or deliberately allow unauthorized use of your account.
  • Contact us promptly if you believe your account has been compromised.
  • We may restrict or suspend an account where reasonably necessary to address fraud, security risks, unlawful activity or a serious violation of these Terms.

5. Orders, Prices & Payments

When you submit an order, you offer to purchase the products in your cart subject to these Terms and the information shown at checkout. An automated order-receipt message may only confirm that we received your order. Unless applicable law provides otherwise, an order is accepted when we expressly accept it or begin fulfilment of it.

Prices
The price shown at checkout is the price that applies to the order, subject to correction of obvious errors before acceptance where permitted by law. Standard shipping is generally included in our product prices unless a product page or checkout clearly states otherwise.
Payment
Products are paid for at checkout using the payment methods then available. Amazigh Shop currently uses PayPal. Payment providers may apply their own terms and privacy policies. We may add or remove payment methods in the future.
Availability
Orders remain subject to product availability, cooperative production or fulfilment capability, and the ability to deliver to the destination. If we cannot fulfil an accepted and paid item, the affected item will be cancelled and refunded.
Taxes & duties
Applicable taxes included or collected by us will be shown where required. Customs duties, import taxes or local charges imposed by the destination may be payable by the customer where they are not included in the displayed price or checkout total and where applicable law permits.
Errors & fraud
We may refuse or cancel an order before or after acceptance where permitted by law if there is an obvious pricing or listing error, payment failure, suspected fraud, legal restriction, or inability to supply the product. If we cancel a paid order, we will refund the amount due for the cancelled item.

We will not impose an additional mandatory shipping or service charge after you have paid without your express agreement. If you request or agree to an optional delivery upgrade or other paid change after ordering, we will tell you the additional cost before you accept that change.

6. Product Information

We aim to describe products, prices, sizes, materials, colors, ingredients where relevant, digital features, customization options and availability accurately. Product-specific information shown on the product page and at checkout forms part of the information provided for your purchase.

Many items are produced, finished or prepared by cooperatives. Handmade and artisan products may have reasonable variations in weave, texture, pattern placement, shade, dimensions or finishing. Natural materials may also vary. These normal variations do not remove your rights if a product is defective, materially different from its description or otherwise does not conform to the contract.

Product categories

  • Physical products: tangible items shipped to the delivery address supplied with the order.
  • Custom or personalized products: items made or altered according to the customer’s specifications. Special cancellation and return rules may apply where allowed by law.
  • Food products: food items may be subject to shelf-life, storage, hygiene, import and food-safety requirements. Any legally required product information will apply in addition to these Terms.
  • Digital products: files or other digital content may be supplied electronically. Product pages may state format, compatibility, access or download conditions and other relevant technical requirements.

7. Shipping & Delivery

We offer worldwide delivery where the relevant product can be supplied and the cooperative or fulfilment partner responsible for that product can ship to the customer’s destination using an available carrier.

Shipping included: standard shipping is generally included in the displayed product price. If a product, destination or requested shipping method requires a different charge, the applicable amount or the way it will be calculated will be communicated before the customer becomes bound to pay it. We do not add an unexpected mandatory shipping charge after checkout.

Carrier selection: depending on the product, cooperative, destination and route, delivery may be arranged through DHL, UPS, Speedaf, a local postal operator, or another suitable carrier. The specific carrier, tracking information and updated delivery estimate may be confirmed after the order once the fulfilment route is arranged.

Special delivery requests: if you need a particular carrier, faster service or delivery by a specific date, contact us before ordering where possible. If you request a paid upgrade after placing the order, it will apply only if you expressly accept the additional cost. If a requested upgrade is not accepted, the original agreed delivery terms remain in place where fulfilment is still possible.

Delivery timing: processing and delivery times vary according to the product, whether it must be made or personalized, the cooperative, destination, carrier, customs and other circumstances. Any specific timeframe shown or agreed for an order will apply. Where no different timeframe is agreed and mandatory EU consumer rules apply, goods must generally be delivered without undue delay and no later than 30 days after the contract is concluded.

Unable to ship: if, after a paid order, the relevant cooperative or available carriers cannot supply or deliver an item to your destination, we will contact you. We may offer an alternative only with your agreement. If the item cannot be fulfilled on the agreed terms, the affected item will be cancelled and refunded in full to the original payment method. We do not charge a cancellation fee for an item that we cannot fulfil.

  • Please provide a complete and accurate delivery address and contact details.
  • Delivery estimates can be affected by customs, holidays, weather, carrier disruptions, local restrictions or events outside reasonable control.
  • Where we select the carrier, responsibility for loss or damage in transit remains with us until the goods are delivered to you or a person you nominate, to the extent required by applicable law.
  • If a parcel is returned because the customer supplied an incorrect address, refused delivery without a legal basis, or failed to collect it after reasonable delivery attempts, reasonable direct reshipping or return costs may be charged where permitted by law.

8. Returns, Refunds, Exchanges & Legal Guarantee

Return and cancellation rights depend on the product, the reason for the return and the law that applies to the customer. Nothing in this section limits rights that cannot legally be excluded.

Change-of-mind returns

Where EU distance-selling withdrawal rights apply, a consumer generally has 14 days after receiving eligible goods to notify us that they wish to withdraw from the purchase. To start a return, email [email protected] with your order number and the item concerned. We will provide the appropriate return instructions and return address.

After giving notice, the goods should be returned within the period required by applicable law. For an eligible change-of-mind return, the customer normally pays the direct return shipping cost where this was properly disclosed before purchase, unless we offered free returns or the law requires us to pay it.

We do not apply an arbitrary general restocking fee. Where permitted by law, a refund may be reduced to reflect an actual loss in value caused by handling beyond what was reasonably necessary to inspect the nature, characteristics and functioning of the goods. Other deductions are made only where they are specifically permitted by applicable law or expressly agreed for an optional service.

Products that may have different withdrawal rules

  • Custom-made or clearly personalized goods: the statutory change-of-mind withdrawal right may not apply where the item is genuinely made to the customer’s specifications or clearly personalized.
  • Perishable food: goods liable to deteriorate or expire rapidly may be excluded from the statutory cooling-off right. Food products are not treated as automatically non-returnable merely because they are food.
  • Sealed hygiene-sensitive goods: where the law provides an exception, the withdrawal right may be lost after the seal is broken.
  • Digital content: where immediate supply or downloading begins during the withdrawal period, the customer loses the statutory withdrawal right only where the legally required prior express consent, acknowledgement of that loss, and confirmation have been provided.

Damaged, incorrect or defective products

If an item is damaged, incorrect, defective or does not conform to the contract, contact [email protected] with the order number and a description of the problem. Where required by law, we will provide an appropriate remedy such as repair, replacement, price reduction or refund, and we will bear return costs when the law requires us to do so.

For consumers buying goods in the EU, there is at least a two-year legal guarantee of conformity for consumer goods, subject to the applicable legal rules and any longer protection provided by national law. This legal guarantee is separate from any voluntary commercial warranty.

Refund timing

Refunds are made to the original payment method unless another method is legally permitted and agreed. For an eligible EU consumer withdrawal, refunds are made without undue delay and generally within 14 days after notice of withdrawal; where the law allows, we may wait until the goods are returned or the customer supplies evidence that they were sent back. Standard outward delivery charges are refunded where required by law. Payment providers may take additional time to display the refund after we issue it.

9. Website Content & Intellectual Property

Unless otherwise stated, the website’s text, branding, logos, graphics, photographs, design elements, product descriptions and other original content are owned by or licensed to Amazigh Shop and are protected by applicable intellectual-property laws.

You may use the website for normal personal browsing and shopping. You may not reproduce, republish, sell, scrape, systematically extract, modify or commercially exploit protected website content without permission or another lawful basis.

Reviews and customer submissions

If you submit a review, image, comment or other content, you confirm that you have the right to submit it and that it is lawful and does not infringe another person’s rights. We may moderate or remove content that is unlawful, fraudulent, abusive, misleading, spam, infringing or unrelated to the relevant service, subject to applicable law.

10. Prohibited Use

You must not misuse the website or services. Prohibited conduct includes:

  • Using the website for fraud, unlawful activity or intentional harm.
  • Attempting to gain unauthorized access to accounts, systems, servers or data.
  • Uploading or transmitting malware, malicious code or other harmful material.
  • Interfering with checkout, payment processing, security systems or another customer’s use of the website.
  • Using automated scraping, extraction or harvesting tools in a manner that violates law, our rights or technical access controls.
  • Impersonating another person, using stolen payment information or deliberately providing materially false information.
  • Copying or commercially exploiting protected branding, images, designs or listings without permission or a lawful basis.

11. Third-Party Services & Links

Our website relies on or links to third-party services, including payment providers such as PayPal, cooperatives and fulfilment partners, shipping carriers, technology providers, analytics or advertising services, social-media services and external websites.

Independent third parties may apply their own terms and privacy policies to their services. We are not responsible for independent third-party websites or services that we do not control, but this does not remove any responsibility that applicable consumer law places on Amazigh Shop for your order, including responsibility for a carrier selected by us where the law provides for it.

12. Website Availability & Information

We aim to keep the website accurate, secure and available, but internet services may occasionally be interrupted, delayed or affected by maintenance, technical problems or events outside reasonable control.

We may correct genuine typographical, technical, stock, price or product-information errors where permitted by law. Nothing in this section allows us to disregard an accepted contract or mandatory consumer rights.

13. Limitation of Liability

To the fullest extent permitted by applicable law, neither party is liable for losses that were not reasonably foreseeable as a result of a breach or for business losses arising from a consumer’s private use of the website or products.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability that cannot be excluded for fraud, intentional misconduct, death or personal injury caused by negligence, defective products where mandatory law applies, or breach of mandatory consumer rights.

14. Responsibility for Misuse

You are responsible for losses directly caused by your unlawful or intentional misuse of the website, your infringement of another person’s rights, or your material breach of these Terms, to the extent that responsibility may lawfully be imposed on you.

This section does not require a consumer to compensate Amazigh Shop for ordinary lawful use of the website, for exercising statutory consumer rights, or for losses that applicable law does not allow us to recover from the consumer.

15. Applicable Law & Consumer Rights

Amazigh Shop operates from Poland and Morocco and sells internationally. The law governing a particular transaction and the competent court or dispute-resolution body are determined by the applicable contract, consumer-protection and conflict-of-law rules.

If you are a consumer, nothing in these Terms deprives you of mandatory protections granted by the law that applies to you, including protections that may apply because of your country of habitual residence.

Where a dispute arises, please contact us first at [email protected] so we can try to resolve the matter directly. Consumers may also use any competent consumer-protection authority or alternative dispute-resolution mechanism available to them under applicable law.
